Overcoming Judicial Accessibility in Times of COVID-19 and Beyond

ABOUT: Problems such as universal judicial access, social accountability, and judicial inefficiency have been chronic in Ecuador. During the COVID-19 pandemic, these problems were expected to aggravate; however, the Constitutional Court developed and implemented the SACC (Automatized System of the Constitutional Court) whose main objective is to address judicial accessibility, enhance transparency, and improve efficiency when delivering constitutional justice. The SACC is a three-phase mid-term project. The first is already implemented and made a significant impact during the pandemic, since it allowed citizens from diverse backgrounds to engage in the most important processes of constitutional adjudication. The other two phases are under development and planning, respectively.

La fase 2 consiste en la automatización de la tramitación de las causas que se sustancian en la Corte Constitucional y la digitalización del expediente. Esta fase finalizará en abril y contamos, además, con una aplicación móvil para facilitar el acceso a los documentos y decisiones por parte de las y los ciudadanos.

Hernan, thanks for your question and you interest in our project SACC. Phase 2 encompasses the automatization on judicial adjudication by the Constitutional Court as well as a digital file for each case. This phase will finish by April and will include a mobile application aimed at easing access to documents and decisions.

Thank you very much for your question and interest in our project! Developing our system SACC during the Pandemic was and is very challenging since the Court had to face budget cuts and technical issues. Nonetheless, the Court has overcome these difficulties and reached excellent results as more than 8000 documents submited by SACC. Greetings from Ecuador!

Thank you very much Belen for your question. The Court developed its own system to submit and store documents based on Hadoop. Additionally, our institution used and continues using Zoom to set up public hearings and social media to help citizens with technical issues and share information. SACC is particularly useful for citizens from isolated areas and who live in other countries since the system allows anyone with an electronic signature to submit documents such as petitions, amici curie and others. Thank you very much for your question! Currently, the team is working on the second phase that spans the design and development of an automated management system to resolve the cases. This includes the digitalization of the constitutional folder, as well as the legal notification. Also, we are implementing an App to inform citizens about the latest decisions and access fastly to the digital folder. This phase is planned to end in April 2021. Thank you very much for your interesting question! SACC has a built-in application to verify the identity of the petitioners. In addition, it has a system to provide data security. We evaluated the results of the first phase through the analysis of quantitative information such as the number of visits, participants in the hearings and the number of submitted documents, Likewise, we measured the degree of satisfaction of both internal and external users with the system through online surveys.   • ¿Cómo el proyecto ha ayudado a la propia Corte, a los demás operadores de justicia y a la ciudadanía en general a enfrentar los problemas derivados de la pandemia de la Covid 19?

En primer lugar, el SACC en su primera fase, incorporó el sorteo automático de las causas que permite que las partes conozcan al juez sustanciador inmediatamente.
Además, el repositorio digital permite acceder 24/7 a las decisiones de la Corte.
Sobre los aportes del sistema en estos tiempos de pandemia, la plataforma de envío electrónico de documentos y las audiencias virtuales han permitido el acceso a la justicia sin poner en riesgo la salud de las personas.
